Welcome to Sightseeing Pass Australia (the Website), which is owned and operated by E-Suede Pty Ltd A.C.N. 604 833 703 trading as Sightseeing Pass (we, us, our or Sightseeing Pass).

Your access to the Website is conditional upon your acceptance and compliance with the terms, conditions, notices and disclaimers contained in this document (collectively known as Terms of Use). Your use of, and/or access to, the Website constitutes your agreement to the Terms of Use. We reserve the right to amend the Terms of Use at any time. Although we may notify you of any amendment, revision or modification, it is your responsibility to periodically review the Terms of Use. You agree to be bound by such changes, modifications or revisions as made by us from time to time.

Our services

We cannot be responsible for any delays or interruptions to the Website. We will use commercially reasonable efforts to minimise delays and interruptions. However, we cannot warrant that the Website will be available at all times or at any given time.

We may at any time and without notice to you, discontinue the Website in whole or in part. However, we cannot be responsible for any loss, cost, damage or liability that may result from our discontinuance of the Website.

Prices and Website Validity

Prices are quoted in Australian dollars (inclusive of GST). Tour prices are per person, are correct at time of publication and can be subject to change at the discretion of SIGHTSEEING PASS AUSTRALIA.

COVID Policy

As an agency (third party) we must advise you to follow hotel and tour operator cancellation policies and the options for modification or cancellation applicable to your booking around a Covid cancellations.  These will be outlined on your receipt of payment which will include terms and conditions around date changes, amendments to bookings and cancellations.

Reservations that are forced to cancel due to a Covid lockdown or Government advice, can be changed or canceled (subject to the cancellation policy disclosed during the booking process). Please note that changes to existing reservations will be subject to availability and any rate differences and may be subject to a new cancellation policy.

Please be aware that most hospitality venues including wineries, bars and hotels across Western Australia including Crown Perth will require proof of double COVID-19 Vaccination, either in a digital or paper-based form, along with approved identification as per the government regulations and check-in with the SAFE WA APP for contact tracing.

Please have your vaccine status printed or ready to show on your screen when our staff request you provide this. Under new current WA Government regulations, we are unable to serve you without seeing proof of double COVID-19 Vaccination.

Inclusions

As specified under the individual tours, products and short breaks however are subject to change solely at the discretion of Sightseeing Pass Australia (E-Suede Pty Ltd).

Minimum Numbers/Itineraries

There may be tours and circumstances where tours haven’t met minimum numbers to operate therefore an alternative tour may be offered or a full refund is offered.

Travel Insurance

Travel insurance is not included. Sightseeing Pass Australia strongly recommends that passengers take out their own travel insurance policy which covers personal liability, cancellation, loss of luggage and personal effects.

Cancellation Policy

A cancellation fee will apply to tours cancelled with Sightseeing Pass Australia on top of the tour operator fees. We strongly recommend you take out travel insurance to cover. Once a booking is made the following cancellation fees will apply:

Cancellation Fees Day Tours and Short Break Tours

  • 30+ days prior to departure; no fee payable
  • 16 – 29 days prior to departure; 25% of total price
  • 15 – 2 days prior to departure; 50% of total price
  • Within 24 hours of departure; 100% of total price

If you fail to join a tour or join it after departure, or leave it prior to its completion, no tour refund can be made. The above cancellation fees are in addition to fees which may be levied by accommodation house properties, travel agents or third party tour and transport operator cancellation fees.

Amendments to Bookings

Amendment Fees

If you wish to transfer from one trip to another or transfer your booking a fee of AU$50 per person per change may apply (in addition to any charges levied by hotels, ground operators). If you notify us less than 15 days prior to the proposed departure date the refund policy applicable to cancellations will apply.

Cancellation by Tour Operators

Tour operators may cancel trips at any time due to terrorism, natural disasters, political instability or other external events it is not viable for us to operate the planned itinerary. If your trip is cancelled, you can transfer amounts paid to an alternate departure date or alternatively receive a full refund. In circumstances where the cancellation is due to external events outside our reasonable control refunds will be less any unrecoverable costs. We are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, Travel Insurance excess or non-refundable flights.

Prohibited conduct

In relation to the Website, you must not:

  • use the Website for any activities or post or transmit via the Website, any information or materials which breach any laws or regulations, infringe a third party’s rights, or are contrary to any relevant standard or codes;
  • use the Website to post or transmit any material which interferes with other users or defames, harasses, threatens, menaces, offends or restricts any person or which inhibits any user from using the Website or the Internet;
  • use the Website to send unsolicited email messages;
  • in any way tamper with, hinder or modify the Website;
  • knowingly transmit any viruses or other disabling features to the Website or via the Website; or attempt any of the above acts or facilitate or assist another person to do any of the above acts.

Intellectual Property

The material on the Website, including the software, design, text, images and graphics comprised in the Website and the selection and layout of the Website are owned or under licence by Sightseeing Pass Australia and protected by Australian and international laws.

Your use of the Website does not grant you a licence or act as a right of use of any of the trade marks or logos, whether registered or unregistered, that are displayed on the Website without the express written permission of the trade mark owner.

We own the copyright, which subsists in all creative and literary works that are displayed on the Website. You may view the Website and its contents using your web browser. In visiting the Website, you may make a temporary copy of the Website by means of the usual operation of your web browser only.

You must not:

  • reproduce or use any of the material on the Website for
  • commercial purposes, including sale; in any way modify the material on the Website; or cause any of the material on the Website to be framed or embedded in another website.

In summary, you must not modify, copy, reproduce, republish, frame, upload to a third party, post, transmit or distribute the content of the Website in any way except as expressly provided for by us or expressly authorised in writing by us.

In the event that you do any of the above acts, we will not hesitate to enforce our intellectual property rights against you.

Limitation of Liability

In the case of services supplied or offered by us: the supply of the services again; or the payment of the cost of having the services supplied again. In the case of goods supplied or offered by us: the replacement of the goods or the supply of equivalent goods; the repair of such goods; the payment of the costs of replacing the goods or acquiring equivalent goods; or the payment of the costs of having the goods repaired.

Privacy

By agreeing to and accepting the Terms of Use, you also agree to the terms of our Privacy Policy.

Termination

Applicable Law

The Terms of Use are governed by and construed in accordance with the laws of the State of Western Australia. You irrevocably and unconditionally submit to the non-exclusive jurisdiction of the Courts of Western Australia and Courts of Appeal from them for determining any dispute concerning the Terms of Use.
